2.           Minutes

              The minutes of the meeting of 15th September were approved as a correct record of the meeting and were duly signed by the Chair.

 

3.           Planning Applications

              Declarations of interest – Cllr Long declared that as a Cornwall Council Councillor his opinions expressed at Cornwall Council may vary from those expressed at Parish level due to wider considerations and further information. He abstained from voting on all items.

              Cllrs Gist and Lumley declared a personal interest in item 3(b),Cllrs Mrs Winfindale and Thomas declared a personal interest in item 3(c)& 3(d).

 

  1. 09/01010/FUL, 64 Boconnoc Avenue.  Retention of conversion of and extension to garage to provide additional living accommodation, Binns.

 

Resolved. It was proposed by Cllr Thomas, seconded by Cllr Gist and agreed by majority that the application be refused as the extension and garage, and the materials used to build it, are not in keeping with the surrounding area.

Should the planning officer be minded to make a contrary decision (i.e. recommend approval) it is recommended that the application be referred to Cornwall Councils East Area Planning Committee for decision.

 

  1. 09/01417/FUL, Workshop to rear of Trevean House, Tavistock Road. Conversion of workshop into residential unit.  Formation of parking area and amenity space, Taylor-Wilson

 

Resolved. It was proposed by Cllr Thomas, seconded by Cllr Harriman and agreed by majority that the application be approved subject to consultation with neighbours and that the Cornwall Council Highways Officers are satisfied with the vehicular access arrangements.

 

  1. 09/01470/FUL, KB Products, Station Road. Construction of chicken shed and associated works, KB Products. 

 

Resolved. It was proposed by Cllr Thomas, seconded by Cllr Gist and agreed by majority that the application be approved subject to consultation with neighbours in the nearby vicinity and that the Cornwall Council Environmental Officers are satisfied with that there will be no excessive smells or other pollution.

 

  1. 09/01466/FUL, KB Products, Station Road. Construction of chicken shed and associated works, KB Products. 

 

Resolved. It was proposed by Cllr Thomas, seconded by Cllr Gist and agreed by majority that the application be approved subject to consultation with neighbours in the nearby vicinity and that the Cornwall Council Environmental Officers are satisfied with that there will be no excessive smells or other pollution.

 

4.           Planning Decisions

a)    09/00722/FUL, 4 Glen View.  Construction of first floor extension to rear of dwelling, Paul.  APPROVED on 2nd September 2009 with 2 conditions.

 

b)    09/00994/FUL, Cathidahn, Tavistock Road.  Construction of pair of semi-detached dwellings with parking (demolition of existing garage), Benton.  APPROVED on 2nd September 2009 with 4 conditions.

 

c)    09/00420/FUL, Florence Rd Industrial Estate, Florence Rd, Kelly Bray. Construction of light industrial unit with associated parking area, Pridham.  APPROVED on 27th August 2009 with 6 conditions

 

d)  09/00916/FUL, 25 Launceston Road.  Construction of two detached dwellings with integral garages (demolition of existing dwelling), Palmer.   APPROVED  on 21st August 2009 with 8 conditions.

 

e)  09/00793/OUT, Land on the north side of Newport Close.  Outline application for residential development, Savage.  APPROVED on 19th August 2009 with 7 conditions.

 

f) 09/01136/FUL, Glenmoor Moss Side. Replacement garaging facilities for funeral parlour, Walsh.  APPROVED on 22nd September 2009 with 1 condition.

 

5.           For Information – Moratorium On Any Future Large Scale House Building in Callington

 

              Earlier in the year (August 2009) it was reported that Mr Doyle, the Assistant Head of Planning & Regeneration for Cornwall Council had responded regarding the pressures on the Health service provision following consultation with the Primary Care Trust and they stated that “Callington Town Council can be assured that it is our intention to continue working together towards maintaining health services in the area and ensuring that the impact of development is properly monitored and managed”.

             

              In consultation with the Education Authority Mr Doyle has stated that “the data clearly illustrates there is no pressure whatsoever on Callington’s educational infrastructure”

             

              Since then Cllr Long has been investigating these claims made by Mr Doyle by talking direct with the schools and health practice to establish what their perspectives are and gave a member’s a verbal update at the meeting.

 

              Cllr Long will report back to the Planning Committee once he has had a response back from Cornwall Council regarding the results of his personal investigation into the claims.

 

6.         For Decision – Affordable Housing; Identifying Possible Sites in Callington and Kelly Bray

 

Cllr Long brought this matter to this committee’s attention as he is aware that Cornwall Council are preparing to contact local councils in the near future and would like this Council to have had sufficient time to prepare a full response to the request.

 

Resolved. It was proposed by Cllr Long, seconded by Cllr Gist and unanimously agreed that Councillors would report back to the Clerk with any recommendations that could be put forward to Cornwall Council (at the appropriate time) once they have been ratified by the Planning Committee.

 

7.         For Decision – Planning Protocols; Contrary Decisions

 

The Head of Planning and Regeneration for Cornwall Council, Mr Phil Mason, has stated that he wants to introduce a new planning protocol as soon as possible and strongly encourages councils to start using it now.  He has informed all case officers that with all new applications received after 1 October 2009 they should be following this protocol where possible. However, if the Town council stress that it wants an application to be taken to the planning committee, the planning authority will not use its delegated powers to decide it.

 

Cornwall Planning will be monitoring the effectiveness of this protocol as well as asking local councils to complete a satisfaction questionnaire on their current working relationships.

 

Resolved. It was proposed by Cllr Thomas, seconded by Cllr Gist and unanimously agreed that the council endorses any planning decisions recommending to refuse an application with the annotation that ‘should the planning officer be minded to make a contrary decision (i.e. recommend approval) that the application be referred to Cornwall Council’s Planning Committee for a final decision’.

  1. 09/01510/FUL, Mayfield, Station Rd, Construction of semi detached dwellings and provision of parking area, Marshall.

 

Resolved. It was proposed by Cllr Thomas, seconded by Cllr A Coakley and agreed by majority that the application be approved providing the relevant mining reports support the application and that the immediate neighbours have been consulted.

 

Should the planning officer be minded to make a contrary decision (i.e. recommend approval) it is recommended that the application be referred to Cornwall Councils East Area Planning Committee for decision.

 

 

4.           Planning Decisions

a)    09/01279/FUL, 45 Broadmead, Callington.  Construction of additional storey to bungalow, Torr.  REFUSED on 29th September 2009 with 2 reasons.

 

 

5.         Non agenda item (as requested by the Planning case officer through the Chairman).

The Planning case officer had asked the chairman to table this planning application as he was minded to make a contrary decision to the Town Councils decision. A short discussion took place after the chairman read out the planning officer’s report.

 

Although a formal decision cannot be taken (the public have not been duly advised of the item for debate) it was proposed by Cllr Gist, seconded by Cllr Lumley and unanimously agreed that the original decision be upheld for the same reasons as given before and that Cllr Long should report this back to the Planning Case Officer.
